I have joined a Masters program in Toronto for two years. I need to know the step by step procedure and how long would it take to acquire a PR.

Answer: So, you are in Canada on a Student Visa ?

When your University course of study is over, you MUST leave Canada, and GO HOME.

When you are back in your own country, you may apply to the Canadian Embassy, in your capital city, to become a Permanent Resident in Canada. If you are able to get PR status, and that is NOT a certainty, you can then come to Canada, to work and live here.

PR status comes FIRST, then after being in Canada for a full 3 years, you can APPLY to TRY to become a citizen of Canada. Again, that is NOT a certainty.

The application process to become a citizen of Canada takes about two years to complete, including a personal interview with a Canadian Citizenship Court Judge, who will ask you questions about why you want to become a citizen. If you pass the interview, and the background checks by CISIS, you will have to write an examination based on your knowledge of our history, geography, laws, political system, and the rights and responsibilities of being a Canadian citizen.

Once you have passed the test with a score of 70 or higher, you will be called to attend a "swearing in ceremony : where you will swear an oath to Canada, and be granted your Canadian citizenship certificate.

I have been separated from my husband for 8 years and we have a ten year old son together. We agree on the custody arrangements but have had the money to file. I am tired of waiting for him to help with the divorce so I am trying to do it on my own but dont have much money being a single mom and working and going to school at night. Any suggestions would be great.

An uncontested divorce or paternity action need not require the two of you to hire attorneys. You need only find a Certified Mediator, hack out the agreement, in detail, file it with the court, and set a hearing date. On that day the judge will swear both of you in, ask if you both agree to the terms set down in the document, than everyone signs it. Generally, there is a 30-60 day waiting period for the document to be recorded with the county and state registries.

The mediator will be a lawyer or paralegal, with specialized training. Each of you MUST pay half the fees. The fees could run from $200 to $1000, depending on the going rates in your area, and time spent on the document. Court fees could run $50 to $150, but if you are tight on money, you could request a waiver.

BIRD NEST CUSTODY
It’s a form of access or custody where the children stay in the former family residence and it is the parents who rotate in and out separately and on a negotiated schedule.

The children simply live at "home" and the separated or divorced parents take turns living with them there, but never at the same time.

The core element of this arrangement is that each parent maintains a separate residence where they live when it is not their turn at the "bird's nest". When one parent arrives for his/her designated time, the other vacates right away, so as to minimize or eliminate the presence of both at the same time.

At times, bird's nest access can be coupled with specified access with the other parent say, for example, for dinner one night a week.

Sometimes, this form of access or custody will end when the youngest child reaches the age of majority at which time, one parent either buys the other out of their interest, if any, in the former family residence, or it is sold and the proceeds divided pursuant to the matrimonial property regime or separation agreement.

The arrangement can be expensive as it generally requires that three separate residences be maintained, the "nest" and a separate residence for each parent.

The concept is somewhat novel and appears to have as its origin a Virginia case Lamont v Lamont.

Do you agree that family court should just handle speeding tickets?

They never seem to make the right decision with disputes. They are totally currupt.

My father is being charged with harassment because he told my moms boyfriend to "stop yelling at my children" well except with more swear words. Now my moms boyfriend is taking him to family court and he could go to jail!
My moms boyfriend said he "feared for his life" mmhmm.

Answer: I have witnessed and agree that Family Courts are corrupt. They're really not in-tune to the real problems, but what the highest paid attorney says. And believe me they'll lie to win their case. The ones that benefit most from the family courts are the judges and lawyers, and the wealthiest clients.

But speeding tickets? Nah, that's for Traffic Court, which is equally corrupt.

Is The Child Support System Fair In Your State?

I can only speak for Indiana.
Some judges will ignore the state statues and make their own rules at the bench.
The attorneys have a "good ol boy" relationship with the judge, so the wont fight it.
The only recourse is to take it to a higher court that may or may not find in your favor and youll pay more in court cost and attorney fees.
I swear, government is nothing more than a "money machine".

Answer: my son is 4 1/2. his father only paid child support for a year of his life, which he stopped almost a year ago. he owes over $3000 in arrears. because of this he can't get a license or passport, and any gst or tax return money get gets is supposed to go to me. i haven't seen anything, though

my fiance is getting the raw end of the deal as a father. he did his taxes before he was taken to court for child support, but then the gov't sent a notice saying he did his taxes wrong and made $40,000 more than he actually did. so now he has to pay $600/month based on that. then a few months later the gov't sent him another notice saying that they screwed up and that he had in fact done his taxes correctly. he tried taking that to the child maintenance ppl and they just looked at him like he was a dead beat dad. he has two other children and a wife to support and makes nowhere near the amount they want him to pay. so he has been unable to pay for a long time now, since we are barely getting by ourselves. he is in the process of going back to get the maintenance order changed.

If you wanted to be a police detective, do you have to be a grunt first or are there detectiv entry positions?

Any guess on the salary range of police detectives? I imagine its not much since theres such high demand for cops. Im going back to school and will finish up my psychology major and want to go on to a master program in psych. Looking at each career field application.

Answer: Generally most police agencies hire/promote from within their department. The duties of a detective require the skills of a patrol officer. A psychology major might help give you an advantage, but will not automatically make you a good detective. Detectives take over where the patrolman ends. The initial report is investigated by following up with interviews of witnesses, suspects and victims. Tracking down these individuals can be a difficult task sometimes. Evidence found at a scene needs to be examined to determine it's usefulness. When a case is ready, it is taken to a prosecutor who determines what charges to file against the suspect. The detective then takes the complaint and warrant before a judge/magistrate and swears to it. The detective is then responsible for arresting the suspect and making sure the case is set for court. Note: You have multiple cases going on at a time.

With overtime, I make about $70,000 a year plus decent benefits, including a full retirement after 25 years, plus a take home car and clothing allowance. (Note our department is heading into it's 5th year without a contract with our union meaning no pay increases for this period of time. Pay should be closer to $80,000 a year by now).

Does the First amendment protect kids that swear in schools?

Can a high school student swear or say anything he wants in a school without consequences according the the first amendment of free speech? Given that the student is not disrupting the learning of other students. Say a student was swearing at lunch time with his friends, does a teacher have the right to give that kid detention or disciplinary action? Wouldnt that be breaking our right of free speech? Or do school have some sort of ability to tell their students that their speech is limited on school grounds?

Answer: This raises an array of questions. Should one cuss and swear in the church during service, not necessarily disturbing the service just endearingly? Then, should one cuss and swear during court proceedings, either as a witness or as an attorney, or a judge, not necessarily offending any particular person but just because one felt it appropriate? Once again, should one cuss and swear during marriage vows just to 'spice up' the occasion? Last but not the least should one use expletives not directed toward individuals, but as routine at the doctors, dentists, bank tellers and so on. Everything does not fall in the category of Freedom of Speech. There are boundaries established by convention and rules at the premises we want to use. How would you like for 'kids' to greet their parents with cuss and swear words first thing in the morning before going to school asking for breakfast. I hope I have put to rest the debate about freedom of speech. A very good question indeed.

I recieved a ticket in a construction zone in Denver there where no workers present, But I have to go to court?

I have a clean driving record this is my first ticket. Do I need to be present if I hire a lawyer to represent me and What should I expect when going to court?

Answer: Workers being present or not is irrelevant. If you are speeding in a construction zone you face the higher fines. Period, end of story.

The court date is only if you want to challenge the ticket, if you want to just pay up and be done with it you can do so. Otherwise if you show up the prosecutor will likely work out a deal to reduce any points you incurred against your license, but don't expect them to cut the fine down at all. If you don't accept the deal then there will be a bench (non-jury) trial in which It will be your word against the cop's word. You will lose. And like I said, the law is written so that it applies to construction zones, whether or not you saw any workers is irrelevant, and the judge won't care if you swear up and down that there weren't any there.

If you want to hire a lawyer you can, and you won't have to show up, but the lawyer will probably only be able to get you the same deal that you would get otherwise, so it's probably not the beat way to spend your money.

I understand that judicial review is not specifically stated in the Constitution of the United States, however, they still exercise this power. Answer: To extend on your question into the realm of Constitutional interpretation, no branch of government can claim an exclusive right or authority to interpret the Constitution because each branch, in the exercise of its authority, interprets the Constitution. This is called coordinate branch construction. None of the three branches has “final” say on the Constitution’s meaning.

Supreme Court decisions are final in particular cases. However, general statements and interpretations of the court beyond those decisions are not final and have regularly been revised or reversed by later rulings. Furthermore, Congress retains the authority to set the jurisdiction of the courts; that is to say, Congress controls the sorts of cases the court may decide.
No branch of government is the exclusive interpreter of the Constitution.

If a judge is to interpret the law -- specifically the Constitution -- with an Originalist view, then it is absolutely necessary that he exercise judicial review - and fulfill his duty to remain in accord with the (supreme) law. If he opts for some other view of the Constitution, then such review would be illegitimate.

The Originalist view maintains that the Constitution is the highest law in the land; it is the law that governs government, and that it is superior to all statutes made by government. This means that any statutes contrary to the Constitution could not have be authorized, and hence are null and void.

Judges must review acts of the other branches to ensure compliance with the (highest) law. So to must members of Congress and the President. Each branch is required to review the assertions of the other branches because they have all swore to uphold the Constitution.

How come in traffic court one party (the cop) says you did something is enough to convict, but not in civil?

The burden of proof is suppose to better higher in criminal court, but in all the traffic violations I have heard of the cop says you did xyz and you say no you didnt and you get convicted, but if you were to go to small claims court and the plaintiff says you did xyz and you owe the money you say no you didnt the judge then goes back to the plaintiff and tells them the burden of proof is on them since they are making the accusation.

Answer: Because in a criminal court, the word of a sworn law enforcement officer has greater weight than the word of someone else. That's because police have been trained, vetted, and are assumed to not have a reason to lie.

In civil court, however, both parties have a financial incentive to lie, so the plaintiff and the defendant are initially given equal weight in their testimonies.

You need only find a Certified Mediator, hack out the agreement, in detail, file it with the court, and set a hearing date. On that day the judge will swear both of you in, ask if you both agree to the terms set down in the document, than everyone signs it. Generally, there is a 30-60 day waiting period for the document to be recorded with the county and state registries.

The mediator will be a lawyer or paralegal, with specialized training. Each of you MUST pay half the fees. That approval is based on YOUR education, the higher the better, and your past work history, and YOUR employment skills. If your skills are not in demand in Canada, you won't get in.

IF you are approved, that process will take about two years, THEN you can come to Canada, to find a job and a place to live.

AFTER you have lived and worked in Canada, for at least three years, you can apply, to become a Canadian Citizen. That application process includes a Personal interview with a Canadian Citizenship Court Judge, and if you pass that interview, you then write a knowledge test, about our system of laws, geography, history and how we govern our country. What is the right to a speedy trial, whats the point if you have to wait in jail until?

I watch jail/prison documentaries religiously and most of the people in jail are awaiting trial. I swear to you most of them were there for a minimum of 2 years because they couldnt afford to post bail. How is 2 years speedy if the trial takes that long to start up?


And when the person is found not guilty does that city give them some kind of settlement for wasting 2 years of their lives? Or are they just screwed and have to start their life over again?

Answer: Great question.

Our American criminal justice system is in dire trouble. We have tremendous backlogs in nearly every court in the country. The dockets are huge. This is another argument/problem -- but is a big reason for lengthy delays before a person enters their trial from their arrest date.

A person is , usually, 99% of the time offered the ability to not SIT in jail with Bail.. Even in high profile murder cases,.. bail is often set. Though, it can be quite high -- which even if one could get a bail bondsman to take them on (which isn't easy with such money on the line) -- 10% of a million dollars is still $100,000 that they don't get back.

Further, property is the absolute best way to bail out of jail from a minor 10,000$ bail to a million dollar bail -- With bail amounts on 'non minor' charges -- most people don't have a million+ dollars worth of property they or their families are willing to put on the line. Think about it, you family may love you but if you have a bail that is hundreds of thousands of dollars,.. and they put their home on the line.. and you end up skipping town, THEY are on the hook for the value of your bail. Which with property would end up , in many cases, be the court /state taking their home to cover the bail amount. They could do nothing about it, and this is a huge risk.

Some people in jail who can't afford bail -- generally have someone in their lives who could put up the property to cover their bail amounts.. ie: 10-20-30,000 dollars -- as most property is at least 50k, if not several hundred thousand. Though many people don't have money -- and I don't mean money as being rich -- I simply mean having family who have assets.. like a home they purchased (mortgage) which could get them out of jail until trial date -- many have family who Rent of a home, an apartment, etc. Rentals are not ownership -- and *most* people (relatives of the person jailed, or friends) don't have even the 10% required on a significant bond of 10's of thousands of dollars to put out there. A $3000, $4000, $5000 or more is general not sitting in peoples bank accounts as disposable income. So the person has to sit in jail until trial (guilty or innocent). Though a person is only supposed to be incarcerated if the state has enough evidence that a judge/magistrate deems they deserve to have a relatively high bail set.. relatively high for many people is anything over $10,000 bail/bond (which would require over a $1000 to be released.)

For those held on relatively minor charges,.. whose bail is a few hundred dollars or so, can generally get out after some period of jail time.. as time served can count towards the bail amount.

The big issue here is many people in jail don't know about the right to a speedy trial.

Further, if they can't afford bail/bond they often can't afford an attorney.

While we all have a right to speedy trial due to the 6th amendment we MUST act on it -- make motions/petitions to the court legally to have it enforced. It isn't automatically enforced -- it is a bit sad that this is the case, but one has to actively pursue the 'right the speedy trial' to have it even be considered.

A defendant can't SILENTLY allow a delay and then LATER claim his right to a speedy trial was denied. So the defendant, again, needs to assert their right to a speedy trial immediately. This can be done with a little research , without an attorney, while in jail. A public defender CAN help with such a process.. but a public defender works for the state and their interest in such matters generally sides with the state.

Courts look at certain factors when deciding whether a defendants right to a speedy trial has been violated. Such factors are:

Length of the delay -- Reason(s) for the delay -- Prejudice or harm to defendant caused by the delay -- Whether defendant *demanded* a speedy trial and at *what stage* of the criminal proceedings. Which again is why the assertion of the 6th amendment needs to be done immediately if bail cannot be met.

Generally, it is presumed that a defendant was denied a speedy trial if there is a delay of ONE year or more from the date of arrest. Though the government usually overcomes this presumptions by giving their *good* reason(s) for the delay.

However the state/government CANNOT delay a trial to aid the prosecution. In other words the trial can't be delayed for the prosecution to prepare, etc. They state/government CAN delay a trial to get an absent witness to be present at trial etc.

A significant delay (years) can cause prejudice to a defendant -- ie: loss of evidence, witnesses, and very commonly the validity of the memory of any witnesses. (Our memories fade and change over time.) Such prejudice which is in FAVOR of the defendant are very valid reasons for violation of the speedy trial.

Can a convicted child molester have parental rights?

My ex-huband is in the middle of a trial for having sex with a minor 14 or younger. I went to court and they found it necessary to have supervised visitation. If he is convicted of this crime serves his time, can he come back in 5 years (my two girls will be around 14) and seek visitation?

Answer: Unfortunately yes, especially if you get a father's rights judge. I think that you will need a very good lawyer but that doesn't mean that you will win. I think that you should send your children to martial arts classes so that they can defend themselves against their pedophile father (not that I would tell him that they are doing that), or any other perverts that might wish to harm them. He Writes:

As a squadron commanding officer, I had to discharge two otherwise fine Sailors who had “popped positive” on urinalysis screens for having THC in their systems. They were good kids, from bad backgrounds - the service had been a lifeline for them, a chance to remove themselves from bad situations.

And I had cut that lifeline - sent one back to the gang infested streets of El Paso. The other returned to East Los Angeles. Truly, my hands were tied.

The Navy has a zero tolerance for drug abuse - it is the surest ticket out of the service, with an “other than honorable” discharge. An OTH won’t debar you from federal employment like a bad conduct discharge, nor is it equivalent to a felony conviction, like a court martial sentence would be. But neither will it move you, by itself, to the “must hire” queue in any prospective employer’s candidate search.

It was not always thus.

When I was a third class midshipman, I cruised aboard a Spruance class destroyer, and drug abuse was fairly rampant - this was back in the late 70’s, and then, as now, many of our Sailors were products of their time. At night an officer could head aft to the helo deck, and watch two or three lounge-abouts flick the burning remnants of a marijuana cigarette over the fantail, and do nothing about it - nothing at all.

Morale in the 80 man supply berthing, where we youngster mids made our racks, was terrible - everyone seemed to hate the Navy, at least among the junior folks - everyone was counting the days until they could get out. It was a real eye-opener.

In 1981, an Marine reserve crew in an EA-6B had a landing mishap (a ramp strike) aboard the USS Nimitz. In the mishap itself, and the resulting conflagration, 19 Sailors died. Eleven were found to have THC in their blood during the post-mortem.

The Navy got serious.

Everything in the Navy depends on teamwork, much of it done around heavy equipment that moves inexorably at great speed - some pieces of gear and environments I have seen could not have been better designed had it been done on purpose to claw and rake at unwary flesh, governed by a diminished mental capacity.

CNO sent out his famous “Not in My Navy,” missive, and routine drug screening began for the first time. CO’s were given temporary authority under “Project Upgrade” to discharge malcontents, malingers and ne’er-do-wells immediately. Anyone who swore they hated the Navy and wanted out as soon as possible was offered the instant opportunity - some took it gratefully (although these were in fact few), some were given it without asking.

The results were dramatic.

The next time I deployed, this time aboard an LST, the USS Barbour County , the difference in morale was incredible. Everyone knew that we had an unshakeable standard, that there was no flexibility, no second chances and for those inclined to gripe about their lot in life, an easy way out - to the ones who wanted to be a part of something special, an organization that stood for something, this was part of the proof that they were.

I remember distinctly the time when a signalman had been found in the act of smoking marijuana - there was a Captain’s Mast, a non-judicial procedure in which the CO is invested as prosecutor, defense attorney and judge, simultaneously. The accused was brought before the CO, and forced to stand at attention. We mids had been asked to watch the process, it being thought good for our professional education. An LST, designed to work in close proximity to the shore (and in fact to run up upon it) is a flat-bottomed boat, and in the relatively high seas between San Diego and San Francisco, our next port stop, she rolled around at an alarming rate and angle. The poor Sailor, standing at attention, was challenged to maintain his balance. Some of the junior mids found his efforts to maintain his footing unbearably humorous, and could not stifle a snigger. The CO wheeled around on them, and tongue-lashed them with great violence in front of the entire assembly until they dropped their eyes to their reddening cheeks in shame.

We got the message - this was a man’s life, about to take a turn very much for the worse. It was nothing to laugh about.

When I was a young lieutenant, and division officer, I had a Sailor who was always in trouble, and worse, who tried to lie his way out of it, transparently, ultimately unsuccessfully. He came from a broken background, his wife had chronic medical issues and the CO was resolute - he would be discharged. I thought this unfair in the larger view, and presented my case to the CO in private. He told me: “Lex, we’ve got a job to do. That man is taking up a disproportionate share of the efforts of a Chief Petty Officer who could be getting that job done, and training his replacements for the job the Navy will have to do 10 years from now. While we are debating about him, your Sailors who have a chance to make something of themselves are wondering where their division officer is. You can’t save them all - some you have to scrape off, for the good of the service.”

After talking with the CO, I no longer thought it unfair. I thought it hard.

And I began to realize - it can be a hard service.

When my turn came to wear the command pin, I had very much hoped not to have any of my Sailors fail the drug test, or otherwise fail to demonstrate a pattern of acceptable performance - These were other peoples sons and daughters, given to me in trust. They had dreams and goals and aspirations that they thought the Navy could help them reach. No one joins to be a failure. I tried to love each of them as though they were my own family, I wanted them all to succeed. Their dreams I tried to make my own.

Oh, I knew that I could never save all of them - some come to us with a lifetime of emotional baggage that cannot be overcome in the short time a Sailor has to prove that he can perform, or not. We are not a charity, not a half-way house.

But I also considered anyone who had to leave the service other than on his own terms as much a failure of my leadership, my ability to reach him and make a citizen of him, as much as his own failure to measure up.

So when one particular Sailor, in whom I had invested a deal of personal time and effort, and who came from a very difficult background, and had been showing great promise, popped positive on the urinalysis test, I was not angry - I was sad.

He hadn’t gone out with the idea of getting high - he’d had a few too many drinks, fell into a bad company, was offered drugs and used them. On Monday morning, his number came up for a random sweep. In a week’s time, he stood before me.

I’ve done a number of Captain’s Masts - and I never really enjoyed them. The mask of austere gravity and dreadful authority that the role required me to wear ill-comported with my ever-present awareness of my own manifest shortcomings, especially those of my youth. Some CO’s that I have seen were “flamers,” those who seemed to enjoy the humiliation of their accused. They’d scream and rant and gesture.

I was never one of those.

For this young man, I had nothing but regret - he and I both knew what he had done, and the penalty it carried. He and I both knew what he would be returning to, having left the Navy as a failure. The Navy, a place where the path and means to success is as brightly illumined as any I can imagine - having failed at this, what could he expect?

But my hands were tied, and he knew it - it was for the good of the service.
